About the Business
With offices in Washington, D.C., Los Angeles, San Francisco, New York, Chicago, and London, Buckley LLP offers premier enforcement, litigation, compliance, regulatory, and transactional services to financial services institutions and early stage and leading fintech and technology companies, as well as venture capital and private equity funds, investment companies, and corporate and individual clients throughout the world.
Our lawyers are focused on assisting reverse mortgage lenders, servicers, and investors with regulatory compliance, transactional, and enforcement issues related to both FHA HECM and proprietary reverse mortgage products. Our regulatory and compliance services include analyzing federal and state requirements and restrictions (e.g., licensing/approvals, housing counseling, marketing, underwriting, disclosures, fee permissibility, cross-selling, UDAP/UDAAP, servicing, claims filing, and GNMA HMBS program), and developing and implementing reverse mortgage products strategies. This includes creating policies, procedures and internal controls for reverse mortgage lenders and servicers (including quality control plan drafting and revision), third-party risk management, and auditing of day-to-day operations.
We also handle transactions related to reverse mortgage products, including structuring, drafting and negotiating loan and servicing rights purchase, assignment and assumption, loan broker, loan correspondent, servicing, sub-servicing and participation agent agreements, M&A agreements, and advising on Regulation AB requirements. We also counsel clients with respect to repurchase demands and other significant issues related to their secondary market agreements. Our enforcement work includes assisting clients with self-reporting issues to regulators, and responding to government inquiries (e.g., information requests, subpoenas, civil investigative demands) and negotiating resolutions for clients.
